Copyright & Fair Use

FACULTY INFORMATION


The library encounters a few common copyright issues surrounding video course reserves:

  • ITS cannot digitize copies of DVDs in our collection as this violates the Digital Millennium Copyright Act (17 USC §1201). While there are exceptions (34 CFR §201.40(b)(1)(ii)(A)), these only apply to copying short portions of motion pictures – even when it may fall under fair use.

  • DVDs or other video recordings placed on course reserve cannot be shown publicly to groups outside of the classroom even when they may be part of a free lecture or campus event (17 USC §106(5), 17 USC §110(1)). Classroom use is fine.*

* In rare cases the library may have a public display license for a film. Consult with us if you're thinking of showing a film outside the classroom.

While there is no exact formula for what constitutes fair use, scanning portions of books and journal articles for use in the classroom is generally allowed.

The library provides scanners for students and faculty to use on the library main floor and we will make efforts to support the educational goals of the college however we can.

However,

  • the library will not scan more than one chapter from any CARLI or ILL books.
  • the library cannot provide legal advice or guidance about what quantity of scanned pages might constitute fair use.
